Validity of the Terms of Sale
1.1 The Terms of Sale apply to the purchase of goods and services between the buyer of Santeco.com online store (hereinafter Consumer) and Santeco Holding OÜ (hereinafter Santeco)
1.2 The Terms of Sale apply to the regulation of the legal relations between Santeco and the private consumer.
1.3 In addition to these terms and conditions, the legal relations arising from the purchase of products from the Santeco online store are governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legislation in force in the Republic of Estonia.
1.4 The Santeco online store reserves the right to make changes to the terms and conditions of the sale. These changes are reflected on Santeco.com.
2.1 All prices listed in the Santeco online store include VAT 20%.
2.2 The price of purchases is added to the price of transportation, which is formed depending on the weight and destination of the purchased goods, according to the method of delivery chosen by the Consumer. The transport price can be known in advance and checked with the help of a special calculator in the cart. For smaller parcels, it is also possible to use the parcel machine service, but with a special agreement with our customer service.
2.3 Prices are valid from the time of placing the order until the expiry of the payment term of the ordered order (7 days after placing the order).
2.4 If the order is submitted before the terms and conditions of sale or prices are changed, the terms and conditions in force at the time of placing the order shall apply to the legal relations between the Consumer and Santeco.
2.5 The Santeco online store reserves the right to make changes in sales prices. These changes are reflected on the Santeco website.
3.1 Add the desired products to your shopping cart. For some products, you can choose additional equipment as a special order
3.2 After you have finished adding the products, click on the link “View cart”
3.3 If you have a discount coupon with a discount code, enter it and press the button “Insert code”
3.4 Choose the desired mode of transport and press the button “Go to checkout”
3.5 Next, choose whether you want to place the order as a one-time “guest” or regular customer (in this case, you will need to log in or register as a regular customer).
3.6 On the order form page, fill in the required data fields, select the appropriate method of delivery and the appropriate method of payment for you, and press the button “Submit order.” Then, an order confirmation will appear on the screen, under which you can pay according to the choice of the previously made payment method. The corresponding Order Invoice will be sent to the email address that you submitted. Before placing an order, you can check the sales terms and conditions of Santeco and confirm it with a separate selection of checkboxes. In the order confirmation displayed on the screen, you will find all the information for making the payment together with all valid state taxes and additional fees.
3.7 Fill in the boxes on the data and order confirmation page carefully, because the accuracy and correctness of the information provided affect the quick and errorless delivery of your purchased products and, if necessary, subsequent resolution of disputes and complaints.
3.8 Orders placed in the Online Store are handled on weekdays (Mon-Fri 8.00-17.00). If the order is submitted after 17:00 on Friday, the order will be made on the following Monday. This also applies to the “I’ll pick it up myself” supply option.
3.9 The Order is valid for 7 days. If the invoice has not been paid within 7 days, the order will expire.
The enforcement of the Sales Contract
4.1 By the contract of sale of the Goods, the Santeco online store undertakes to hand over to the Consumer the Goods that are existing, in manufacturing, or acquired by the Santeco.com online store in the future, and to make possible the transfer of ownership to the Consumer, while the Consumer undertakes to pay the amount indicated in the invoice for the Goods to Santeco.com and to accept the Goods.
4.2 Orders for which no payment has been made shall be cancelled after 7 days from the date of placing the order.
4.3 The sales contract enters into force after the payment made by the Consumer is received in Santeco’s bank account.
5.1 After the enforcement of the Sales Contract, the Santeco.com online store will complete the order and deliver it to the customer according to the method of transport chosen by the customer (except in the case of the delivery condition “I’ll pick it up myself”).
5.2 The delivery deadlines indicated on the Santeco.com page apply from the moment the order amount is received in the bank account of the Online Store.
5.3 In order to avoid delivery delays, correct and valid data must be provided when entering delivery data while placing an order.
5.4 The Santeco.com online store shall not be liable for the delay in the delivery of the goods if the goods have been delivered to the logistics partners (if the corresponding delivery method has been chosen) on time, but the delay in delivery is due to circumstances that could not be affected by the Santeco.com online store and cannot be foreseen.
6.1 After receiving the order, the Consumer has the right to withdraw from the contract entered into in the Online Store within 14 days without disclosing the reason. According to subsection 53 (4) of the LOA, the consumer does not have the right to withdraw from the contract if the product is manufactured, taking into account the personal needs of the consumer who is a party to the contract. These are all the products we have processed (cut, painted, changed components, details, etc.) according to the customer’s wishes.
6.2 If the condition of an object subject to return deteriorates, the Consumer shall be liable for the decrease in value caused by the use of the thing only if the Consumer has used the object in another manner than is necessary for ascertaining the nature, characteristics and functioning of the product. In order to verify the nature, characteristics and functioning of the object, the consumer should handle and use the object only as he would normally be allowed to do in the store.
6.3 The consumer shall bear all costs related to the transport, removal, cleaning (e.g. removal of silicone) and packing of the product.
6.4. The product must be returned in the original package
6.5 To return the product, the consumer must apply for withdrawal from the purchase of the product in free form, and send it to email@example.com no later than 14 days after receiving the product.
6.6 The consumer must return the product within 14 days of the submission of the application or provide proof that he or she has transferred the goods to the logistics company during the aforementioned period.
6.7 The customer does not have to return the product via a logistics company if the Santeco.com online store has agreed to pick up the goods itself.
6.8 The amount of the order paid by the Customer shall be refunded to the Customer as soon as possible, but not later than 14 days after the submission of the application for withdrawal from the purchase of the goods. If the order is partially returned, the delivery cost shall be refunded in proportion to the number of returned products.
6.9 The amount of the order paid by the Customer shall not be refunded until the returned goods have reached the warehouse of the Santeco.com online store.
6.10 Spoiled goods shall not be treated or withdrawn.
7.1 The Santeco.com online store shall not be liable for any damage caused to the Customer or for any delay in the delivery of the goods if the damage or delay in the delivery of the goods is due to circumstances under which the Santeco.com online store could not have affected or foreseen.
Processing of personal data
8.1 By entering data in the Online Store, the Consumer grants the right to collect and process the Consumer’s personal data (name, contact phone, home address, email address) and to forward personal data to the logistics partner for the delivery of the goods.
8.2 The Santeco.com online store has the right to use the address of the place of residence or location of the Consumer to communicate advertising and other information to the Consumer.
8.3 The consumer has the right to prohibit the collection and use of their personal data at any time unless this is necessary for the collection of a claim arising from the contract or for the delivery of the goods.
8.4 The use of electronic personal data for direct mail only takes place if the consumer has given their separate consent to it on Santeco.com.
8.5 Encrypted data communication with banks when paying for purchases ensures the security of the consumer’s personal bank identifiers and the Online Store does not have access to them.
The procedure for submitting claims
10.1 The Santeco.com online store is responsible for the lack of conformity of the goods sold to the Consumer or for deficiencies that occur within up to two years from the delivery of the goods to the Consumer.
10.2 In the event of a defect, the consumer has the right to contact Santeco.com within two months at the latest by submitting the invoice on the basis of which the purchase of the goods was paid.
10.3 In the event of a defect in the goods, the use of the goods shall be discontinued.
10.4 Repair or replacement of defective goods is agreed between Santeco.com and the Consumer. The cost of repair is covered by the Santeco.com online store.
10.5 Santeco.com online store is not liable for any defects caused by the consumer’s fault in the product as a result of improper storage or non-purposeful use of the product.
10.6 If a product does not meet the requirements or deficiencies, please send a complaint to firstname.lastname@example.org, indicating the name of the person placing the order, the contact number, the order number and the exact description of the product’s non-compliance or defect.
10.7 A complaint concerning the discovery of non-conformity or deficiencies of a product shall be filed within two months of the discovery of non-conformity or deficiencies of the product.
10.8 All complaints shall be reviewed and the Consumer shall be contacted as soon as possible, but not later than within 14 days after receipt of the complaint.
10.9 The consumer has the right to demand that the Santeco.com online store reduce the purchase price or terminate the contract and reclaim the money for the goods, if the Santeco.com online store is not able to repair or replace the goods, the repair or replacement of the goods fails, the Santeco.com online store has not eliminated the shortage of the goods within a reasonable time, unjustified inconvenience has been caused to the consumer.
The Consumer’s right to turn to the Consumer Disputes Committee
11.1 If the Online Store has refused to resolve the Consumer’s complaint or the Consumer does not agree with the solution offered by the Online Store and finds that their rights have been violated or their interests have been damaged, the Consumer may file a complaint with the Consumer Complaints Committee through the Consumer Protection Board or with a court. The consumer may lodge a complaint themself or through a representative. The data of the Consumer Protection Committee are provided on the website of the Consumer Protection Board, to address problems arising in the Member States of the European Union to the European Union Consumer Advisory Centre.
